    We have no written policy outlining when and where a deputy may review the collected evidence used in their IA.

    Yes, we do place the evidence on a thumb drive and allow the deputies to review it prior to their interview. We estimate how much review time it will take and make a decision on whether they can do it on their time. (BWC footage, witness interviews, phone data, etc.) We generally schedule their interview as soon as they are done reviewing.

    I am not aware of any 112 violations that would come from this practice. We often tell the deputies representative that we are providing them with the thumb drive ahead of time.

    Below is what our Arrestee Transport policy states:

    Absent exigent circumstances, all prisoners will be transported in an agency vehicle in an upright, seated position, secured by a seatbelt.

    Attached is our agency’s flow chart which shows the units under the Special Operations Division. SWAT reports directly to the High Risk Incident Commander (HRIC).

    We do not have an overall policy for the Special Operations Division.

    The policy that pertains to riots and demonstrations is attached.

    Discipline Records
    1. When an allegation of misconduct is sustained, any discipline imposed, either formal or informal and the associated documents must be kept in compliance with the State of Florida General Records Schedule. The Internal Affairs supervisor shall maintain the records in a secure area.

    2. A copy of all completed Notice of Disciplinary Action forms shall be forwarded to the Human Resources Section and the Finance Section (if there is loss of pay).

    3. Annually, the Internal Affairs Supervisor or designee shall review all employee files and purge disciplinary records as follows:
    a. Informal discipline must be kept for three (3) anniversary years after the final disposition date.
    b. Formal discipline must be kept for five (5) anniversary years after the final disposition date.

    Below is what is stated in Policy 458.0 which is attached.
    6. Juveniles may be used as CI’s, CS’s or Investigative Assistants with the CID Bureau Major’s approval and a signed waiver on file from the parent or guardian. {CFA 15.03}
    a. Juvenile Informant files are subject to documentation and control procedures and shall comply with Juvenile Records Procedures (see Policy 222.0, Records). {CFA 15.03}
    b. All Juveniles being used as a CI, CS or Investigative Assistant shall be introduced to two members of the unit and at least two sworn members shall be present at all meetings with the juvenile.
    c. All meetings with juveniles being used as a CI, CS, or Investigative Assistant shall be audio and/or video recorded.
    d. Sworn members shall select the time, place, and method of any meeting.
    e. Special precautions that may be taken with juveniles being utilized as a CI, CS or Investigative Assistants include but are not limited to the following:
    (1). Meeting the juvenile in a public place with his/her parent or guardian.
    (2). Monitoring the juveniles known social media platforms.
    (3). The lawful use of electronic surveillance tools.
    (4). Covert physical surveillance of the juvenile.

    Nose rings or posts, tongue rings or posts, or any other piercings or posts of any kind in or on any area of the body that is normally Visible to the public are not permitted, except earrings as listed in section E.
