Someone at our State Attorneys Office (19th circuit) prepares a monthly report summarizing any Florida legal updates for that month. She sends the report to our Training Unit and they send the information out to the agency. I requested to be on the SAO email list so I also receive them directly from her now. Reach out to your SAO to see if they do something similar.

We have not started on this yet. I believe there is a lot more that has to be done before LEOs are allowed to conduct the assessment. We have to wait until all of the policies, procedures, and training have been established and then only after a LEO has received the training will they start using the approved FDLE created lethality assessment form. Some of the questions in the new law still have to be reviewed and may be changed before becoming official. 🙂

Refer to Chapter 705, Florida Statutes.

I spoke with our Evidence Unit and was advised that there is a specific law relating to the equipment (paraphernalia) used in grow houses that allows it to be destroyed on-scene. I found that in 2008 new legislation was passed regarding an alarming increase in the number of grow houses being maintained in Florida, which was causing a huge burden on law enforcement being required to store massive amounts of cumbersome grow house equipment as evidence. Florida Statute 893.10 was amended to allow this practice for ‘manufacturing equipment’ after following certain procedures. I could not find anything that gives discretion for destroying paraphernalia that is simply found somewhere and at our agency it is to be turned into evidence/property. Not sure if this is helpful, but I just wanted to let you know about the grow house exception to the evidence submission requirement.

Could you please send the statute number this is referring to? – I found it.

Our agency doesn’t issue that firearm but it was authorized as an off-duty/backup. As of 8/2023, it is no longer an agency authorized off-duty/backup firearm.
